1. Content ownership:
You confirm that you are the owner of all intellectual property involved in the order.
Your order will not be started until we also receive a signed
Anti-Piracy form from you. You agree that you can provide proof of ownership if required.
Modern CD LLC can pause or stop an order if we think material is being duplicated that should not be.
By placing an order with us you represent that you have the legal right to produce all materials ordered from us. In the event that anyone makes any claim against us based upon an allegation that the product you ordered and which we produce infringes any copyright, patent, or other proprietary right of any person; or contains any matter that is libelous, slanderous, defamatory, scandalous, obscene, or unlawful, you agree to indemnify (ie. Pay or Reimburse) Modern CD LLC for any losses and expenses we incur as a result of the claim.

Modern CD LLC can cancel an order at any time if we feel the order is damaging to Modern CD LLC
and other parties involved. Modern CD LLC reserves the right to refuse or cancel any order.

Modern CD LLC reserves the right to change prices, colors, materials, specifications and quantities in
our marketing pieces, web site, or elsewhere without notice or obligation at any time.

2. Marketing:
From time to time Modern CD LLC updates its marketing materials with pictures of customer orders.
If you clearly DO NOT want any part of your project displayed on any marketing materials, you MUST
specifically state that to us at the time of your order. If your product image is used, compensation or
royalties will NOT be paid out.

3. Turn around times and Delivery:
Turn around times and delivery dates are approximate. WE DO NOT GUARANTEE DELIVERY DATES. All prices are F.O.B. at our production facility unless otherwise specified in the quotation and your written order.

4. Printing and Production:
Artwork proofs will be sent digitally for every order. Production WILL NOT start until the artwork proofs are
approved by the customer. All art will be color matched as best as possible. We can not guarantee colors
unless you provide us with a PMS number or an actual sample to color match to. Hard copy proofs are available at the customers request for an extra charge. Due to normal variations in equipment, processing, printing substrates, paper, inks, pigments, and other conditions that may occur, a reasonable variation in color between color guides You provide and the completed job is normal. If You are present for a press check, We will adjust the color to Your reasonable satisfaction. If you are not present for a press check and a color variation occurs that is within industry standards, You agree to accept it. Orders will not be re-ran at the expense of Modern CD LLC if colors do not meet your approval unless we feel it was an error during the production process. Once a proof as been approved and production started, an order
can not be stopped due to content, spelling, or other errors that were supplied to us.

Data content will be exact duplicates from the master you supply us with. Master formats
accepted are CDR or DVDR masters. All discs are checked for bit errors against the original master.
Content is not listened or viewed 100% through. We advise you to check your master thoroughly before
submitting it for production. Modern CD LLC uses other partners and supply chains to help offer the most
cost effective price and highest quality end product for your specific job. Our vendors are qualified and
monitored to the best ability by Modern CD LLC . Modern CD LLC is not responsible for business ethics
or processes of our vendors.

5. Payments: Payments are accepted in the form of, money orders, checks, and credit cards. If payment is
not received by its due date, an interest rate of 1.5% will be charged per month on the invoice total until
the balance is paid off. No order will start until payments are received or a Purchase Order is submitted.

6. Orders:
Orders must be made by purchase order, online interface, email, order confirmation or other writing containing essential information. We do not accept verbal orders and they are not binding on us. If you approve your proof, your job will be considered approved for production, we will move forward with your order. If you find mistakes after you have already approved your proof you will be charged a job cancelation fee which may total the entire amount of the project quoted.

7. Quotations:
A quotation is an estimated price for work based upon the information you provide Us and the costs of materials and labor at the time of the quotation. A quotation is subject to change after thirty (15) days from its date if the costs of materials and labor change, or if your order varies from the information supplied at the time of quotation.

8. Claims:
You must make any claim for defective, damaged, or non-conforming products or for quantity shortages in writing within fifteen (15) calendar days of delivery of the order, or if the order is shipped in parts, delivery of the affected portions. If you fail to make a timely written claim you irrevocably accept the products and admit that the products fully comply with the terms, conditions and specifications of the order. We retain the right to inspect any products you claim to be defective, damaged or non-conforming. If we determine that any product is defective, damaged, or non-conforming due to Our fault, we will credit your account for an amount up to the selling price of the defective, damaged or non-conforming goods. If we determine that any defect or damage occurred without our fault, including any damage occurring outside of our facilities, you will not be entitled to credit. You may not under any circumstances return any product to Us without our prior written authorization. All returns must bear a Return Number prominently on the outside of the shipping carton. We will not pay shipping for unauthorized returns

9. Over-run / Under-run:
We have the right to ship and bill you for the quantity ordered plus-or-minus 10%. Short run orders have a smaller tolerance or none at all.

10. Pricing:
Pricing may change at any time. Sometimes our web site contains errors. We try our best to keep an accurate site, but mistakes do happen. If you order and the price is inaccurate, Modern CD LLC will update you of the price change as well as notify you that we made the correction on the web site. If you choose to accept the updated price, we will continue with the job. If not, we will cancel the job and refund you 100%.
